Fourteen months in prison without trial
15 year-old Ö.S.,who was detained in Erzurum on July 20, 2010 and arrested and put in prison for allegedly being "a member of the terrorist organization", has stood trial for the first time after 14 months.
Arrested Ö.S. has been sent to five different prisons for 14 months and held in isolation conditions. The trying Juvenile Court has ruled the continuation of imprisonment while the next hearing was postponed to September 29.
According to Bianet’s report, lawyer Müþir Deliduman remarked that the judge of Juvenile Court Judicature has accepted his petition conveyed to the Juvenile Court Judicature to demand Ö.S.’s release pending a trial.
Pointing out that the Erzurum Department of Justice Committee has this morning appointed the judge of the court temporarily to another district, lawyer Deliduman noted that the hearing was continued with another new judge who has been appointed to the case despite knowing nothing about the subject.
Deliduman stated that the judge ruled the continuation of imprisonment with the justification of “uncollected evidences” despite the nonbeing of single evidence and the statement of Rýdvan S, who was arrested with Ö.S., that “Ö.S. has no concern with the event”.
Lawyer Deliduman indicated that they hold the Erzurum Department of Justice Committee responsible for the decision for appointing an uninformed judge to the place of the trying Juvenile Court’s judge.
Erzurum Department of Justice Committee has violated the Convention on the Rights of the Child, which is binding for the party country Turkey as well, by not protecting the high benefit of the child. Deliduman added that “Children's Rights Act, the United Nations
Convention on the Rights of the Child, the Article 5 of the European Convention on Human Rights concerning the right to liberty and security and the Article 6 concerning the right to a fair trial has been violated.”
