Hunger strike for lawyer of 14 years old jailed boy

The lawyer of a 14-year-old Kurdish boy, who has been held in solitary confinement for one month and imprisoned for 10 months in Rize L-type prison, has gone on a hunger strike.

It has once again revealed that the amendment enacted in 2005 by the AKP government, which allows for the judgment of Kurdish children at high criminal courts within the Anti-terror Law, is a bluff.

The 14-year-old Kurdish boy O.S. was taken into custody in Erzurum on July 21, 2010. Despite the amendment enacted one day later, O.S. was questioned by the competent prosecutor instead of a juvenile prosecutor. O.S. who was arrested after, has not been brought to justice yet as his indictment is still uncompleted. And what is more, the child was exiled to 4 separate prisons in the 10-month period. Not restricted with these, the torture on O.S. continued and increased with the insults of the prison’s authorities, attacks in the adult ward he was put into and the solitary confinement he has been subjected to since March 2.

Reacting against the situation, O.S. 's lawyer, Contemporary Lawyers' Association (ÇHD) member Müsir Deliduman started a one-day hunger strike to draw attention to the “injustice in children' proceedings”.

Commenting on the association’s action at the building in Taksim, Deliduman called attention to the Child Protection Law No. 5395 and said the followings; “The purpose of the Law is to regulate the procedures and principles for the protection of children pushed into crime and ensuring their rights and safeties”.

Deliduman expressed that hundreds of children in Turkey are questioned and tried under conditions for adults, their freedom is restricted and they are arrested in contravention of the UN Convention on Rights of the Children, despite the country’s being a party to it.

Deliduman emphasized that O.S. is exposed to exile among prisons while the juvenile prosecution must legally issue the indictment to start the process of litigation. Deliduman added; “O.S. is still alone in C1 ward at Rize L-Type Prison. We say that the place of children is not behind the bars”.

Following his statement, Deliduman started a one-day hunger strike.
