Constitutional Court rejects application demanding injunction for Öcalan

Turkish Constitutional Court has rejected the application filed by Asrın Law Office demanding an injunction order for Kurdish People’s Leader Abdullah Öcalan.

Lawyers from Asrın Law Office advocating Kurdish People’s Leader Abdullah Öcalan wrote a 10 pages long application to the Constitutional Court on July 20 and demanded an injunction order. In their application, the lawyers stated that Öcalan’s rights have been violated, he was targeted during the coup attempt, and there has been no communication with him since the coup attempt.

The lawyers stated that there were enough reasons to think that Öcalan was targeted by the coup plotters on July 15, and expressed their concern over the threats against his right to life. The lawyers said it was crucial for Öcalan to be able to meet with his family and lawyers in order to alleviate the concerns regarding his health, and demanded an injunction order for the Kurdish leader.

Announcing the rejection of the application today, the Constitutional Court based the rejection on the grounds that there was no need for an injunction because the application was not in this scope although it could be decided whether the applicant faced any critical threat against his life and material or spiritual integrity.

Rezan Sarıca, one of the lawyers for Öcalan, criticized that the Constitutional Court has not seen the danger that is existing before the eyes of the whole world, saying that it is still not possible to understand the rejection of the court judicially.

"It is obvious that the Court has treated this issue politically and does not act in line with the European Convention on Human Rights and the Constitution. This rejection is the same kind of the decisions made by the Constitutional Court during the process of curfews. This decision extinguishes the law and paves the way for the continuation of this aggravated isolation. Still, we will resort to international mechanisms against this decision because our concerns will not be relieved until Mr. Öcalan is accessed and confirmed to be in good state of health and security", Sarıca said.
