Ten months of prison for a piece on the internet

Yuksekovahaber.com internet site’s coordinator Erkan Çapraz has been sentenced to a year in prison for a piece written by Selim Saklý titled “Biz kardeþ deðiliz!” (We are not brothers) and the court postponed the decision.

Antenna TR website reported that Yüksekova 1st Criminal Court of First Instance found the published piece on April 27, 2010 to be stirring hatred and animosity among the public. Saklý’s piece is on the assault on Ahmet Türk in Samsun aünd its effects on the Kurdish people.

Judge sentenced Çapraz to a year in prison under TPC 216/1 and reduced it to 10 months by favorable discretion but refused to change it into cautions. Thus Çapraz is deprived of his certain civil rights. The journalist will not be able to hold a public office of any duration permanent, temporary or otherwise; will not have any electoral rights or any other political rights; and will not be able to take part in various other civil procedures till his sentence is terminated..

Since the decision is postponed he will be on controlled probation for the next five years and in the case of him committing a similar offense the postponed sentence will be effective.
