The European Court of Human Rights convicted Turkey for using pepper gas against demonstrators during the NATO summit in Istanbul in 2004.
In the case concerned with the complainant Ali Güneþs application to ECHR against Turkey, the ECHR chamber ruled a violation of Article 3 of the European Convention on Human Rights which prohibits inhuman or degrading treatment.
The European Court of Human Rights ordered Turkey to pay Ali Güneþ 11,500 euros in respect of nonpecuniary damage as well as costs and expenses.
The case concerned a complaint by a high-school teacher who took part in a demonstration against the 2004 NATO summit in Istanbul that the police had ill-treated him, including by spraying tear gas on him.
The Court found in particular that the authorities had been unable to justify the use of tear gas against Mr Güneþ after he had already been apprehended by the police; and, no effective investigation had been carried out into his related complaints.
The Court rejected Mr Güneþs complaint that he had been unlawfully arrested, as it found that the Turkish authorities had complied with the applicable procedures.
