HDP Şırnak MP Ferhat Encü is on trial for requesting aid for the wounded in Cizre during the days of the curfew. The first hearing was held in the Çorum 4th Criminal Court of General Jurisdiction.
The lawsuit had been filed on complaint against Şırnak MPs Encü and Sarıyıldız speaking on Hayat TV during the days when efforts to get ambulances to the 28 wounded people in a basement in Cudi neighborhood in Cizre district continued.
Encü is on trial along with HDP MP Faysal Sarıyıldız on charges of “promoting animosity and hatred among the people”. He attended the hearing through SEGBİS from Kocaeli Type F Prison where he is currently held.
Encü pointed out that their legislative immunity was lifted in an unconstitutional way and said: “According to the amendment clause, this adjustment is valid for all MPs, but in practice it has only been used as the sword of Damocles over the heads of HDP MPs.”
Encü pointed out that the indictment exposed that the lawsuit is political and said: “A summary has been drafted for us with a careless attitude, without any research. This summary was rushed to the parliament just before the vote for lifting legislative immunities ‘for one time only’. The only evidence in the file is the complaint against us filed through BİMER (Prime Ministry Communication Center).”
HDP MP stated that during the days when he gave the speech on trial, 28 wounded people were waiting in a basement in Cizre’s Cudi neighborhood and added: “A university student, Cihan Karaman, had lost his life despite the injunction issued by the ECHR. Şırnak MP Faysal Sarıyıldız and I are once more made out to be the suspect in the events we witnessed. Talking about what happened in Cizre, announcing the truth isn’t promoting animosity and hatred. It’s not my words that need to be on trial. Putting my words on trial is a sign of the judiciary freakshow.”
