Lawyers for Freedom condemn blocking of treasury aids to HDP

The Association of Lawyers for Freedom (ÖHD) Amed Branch said that the blocking of treasury aids to the Peoples' Democratic Party (HDP) was unlawful.

The Association of Lawyers for Freedom (ÖHD) Amed Branch held a press conference concerning the blocking of the treasury aid ruled by the Constitutional Court (AYM) upon the request of the Chief Prosecutor of Court of Appeals. ÖHD Amed Branch Co-Chair Özüm Vurgun said that a prosecutor made the same request in the closure case against the HDP, but the Constitutional Court rejected it, saying that "no concrete evidence was presented". Vurgun said: "The blocking of the treasury aid, which is devoid of any legal justification and without giving the HDP the right to defend itself, is clearly unconstitutional."

Vurgun said: "The decision to block treasury aid violated the procedural laws and is thus unconstitutional."

'BLOCKING IS POLITICALLY MOTIVATED, NOT LEGAL'

Vurgun said: “A two-thirds majority is required for objecting to constitutional amendments, closing political parties and blocking of treasury aid. For this reason, the court’s ruling is unconstitutional in terms of procedural laws."

Vurgun continued: "The Constitutional Court is the highest judicial authority responsible for supervising the compliance of laws with the Constitution. In the past, decisions were made against other democratic and oppositional Kurdish parties in defiance of the constitution. This recent ruling is politically motivated."

Vurgun added: "According to the constitution, voters are represented by deputies who receive a certain amount of financial aid from the treasury in order to fulfil this duty of representation. Without support, activities of a political party will be disrupted. This leads to outcomes in favour of other political parties. We call for an immediate revoking of this decision, which is clearly unconstitutional."
