The European Court of Justice ruled that Germany cannot ban Roj TV broadcasting in Germany.
European Court of Justice announced its decision to the German Federal Administrative Court’s application regarding the ban of Roj TV.
The court underlined that the closure of Roj TV can only be ruled by the Danish authorities that are responsible for the supervision of the broadcast as the channel broadcasts from Denmark. On the other hand, it was remarked that Germany can ban Roj TV’s broadcast preparation in Germany.
German Interior Ministry banned the activities of the Mesopotamia Broadcast company, connected with Roj TV, in Germany in 2008 on the grounds of ‘preparing programs contrary to the harmony between the peoples’. The studios of the Kurdish production company Wiko GmBH, which sells program to Roj TV, were raided and the company activities were stopped in Germany following the ban.
Applying to the German Federal Administrative Court, Roj TV objected to the decision and demanded the removal of the ban. The Federal Administrative Court conferred on the European Court of Justice about whether the Interior Ministry could rule a prohibition or not.
