Appeal for lawyer Riþvanoðlu
The case of lawyer Þiar Riþvanoðlu, member and former chairman of ÇHD (Association of Contemporary Lawyers-Adana branch), writer for workers’ newspaper Gerçek (“The Truth”) and editor in chief of review Devrimci Marksizm(“Revolutionary Marxism”), is going to be concluded in Adana on Friday 10 February.
The lawyer is under trial for his thoughts, expressed during three programs on Kurdish satellite television RojTV. Opinion of counsel for the prosecution is the punishment for propaganda.
In the previous trial, an analysis of program CDs for all the participants not only for Þiar Riþvanoðlu was denied by the court board and allowed for time of defence for the file as it is.
The issue of this case only the opinions which was expressed by our friend and from that point of view it is severe blow for freedom of thought and expression which is one of the most fundamental human rights.
Two more case are ongoing for Riþvanoðlu who has been on trial several times because of similar reasons in his writings and speeches.
One of them is at Adana third criminal court of first instance file 2011/297 because of being a member of organisation committee for 2010 Adana Newroz celebrations.(Next trial of this case is on 8th March 2012) The second one is a claim by Interior Ministry at Adana second civil court of first instance file 2010/558 because of common press statement red by him on suspicious death of Metin Alataþ who was the deliverer of Azadiya Welat (The unique Kurdish daily newspaper) was found hanged on an orange tree.(The trial of this case on 31st May 2012)
Writing to support their colleague, lawyers from ÇHD underlined that Þiar Riþvanoðlu "has been the lawyer of intellectuals such as Sibel Özbudun, Ýsmail Beþikçi, Fikret Baþkaya, Temel Demirer, Sungur Savran and assigned to the well known cases such as Hrant Dink, Uður Kaymaz, Þemdinli, KCK (Diyarbakýr, Adana, Mersin)".
Today, the lawyers write "on several different publishing writers, who are not a danger for the system and who have close relationships with capitalists, mention radical opinions for the solution of Kurdish issue and they have been taken no legal action which is the right thing. On the other hand our friend has been systematically on trials which show that these cases are related to his socialist identity and the platform that he expresses himself rather than his actions".
The statement also pointed out that "42 colleagues of us are in custody and 33 colleagues are arrested now and most of them are member of ÇHD. The situation reminds the time of Mc Carthy in USA during 40’s called witch hunt. This is the clear evidence that the attacks are especially against the lawyers".
Lawyers call to show solidarity at Riþvanoðlu’s "especially these days when possible law changes to the TMK (Anti-Terror Law) are being discussed".
Lawyer Þiar Riþvanoðlu will appear at Court on 10th February at 09:30 at Adana (6.Özel Yetkili Aðýr Ceza Mahkemesi) assize authorized sixth aggravated felony court.
