Constitutional Court rejects Court of Cassation request to freeze the HDP’s accounts

An application by the Court of Cassation's Chief Public Prosecutor to freeze the HDP’s accounts was unanimously rejected by the Constitutional Court.

Rejecting an application by the Court of Cassation Office of Chief Public Prosecutor, Bekir Şahin, the Turkish Constitutional Court (AYM) in Ankara ruled on Monday that the Peoples' Democratic Party (HDP) may continue to use its funds from state party financing.

Şahin had asked the court a week ago to freeze the HDP's accounts and demanded that much of the support money paid out for 2023 be flushed back into the state coffers. The 15-member bench of the Constitutional Court unanimously rejected this request.

According to the Turkish Law on Political Parties, parties receive three times the proportionally calculated financial aid from the state for the year in which general elections are held. The HDP has received just over 600 million liras, the equivalent of about 23 million euros, for this year. However, Şahin demanded that two-thirds of the money from the state budget be paid back because the HDP did not run in the parliamentary and presidential elections in May under its own banner but through the list of the Green Left Party. In addition, he demanded that money already used be siphoned off from the funds allocated to the party executive. The judges at the Constitutional Court also spoke out against this request.
