German Constitutional Court: There is risk of torture in Turkey

Germany's Constitutional Court decided against the deportation of a radical Islamist to Turkey because of the risk of torture.

The court said that a member of a gang group in Syria cannot be deported to Turkey because he may be exposed to torture or inhumane treatment.

Previously German courts didn’t refer to the risk of torture in deportation cases to Turkey. The decision by Germany’s Constitutional Court will affect all deportation trials.

The decision also highlighted the failure of the Turkish state to establish the rule of law.

The judges referred to a report by the international rights group, Amnesty International, and decided against the deportation.
