The Permanent Peoples' Tribunal on Rojava vs. Turkey in Brussels continues with presentations.
The second case presented to the Permanent People's Tribunal was dedicated to the "Massacres, bombings and torture of displaced civilians in Tel Rifat". The case was presented by lawyer Rengin Ergül.
Lawyer Ergül said: "On December 2, 2019, between 1:30 p.m. and 2:00 p.m., a shell struck the Al-Shahba garage neighborhood in Tel Rifat, Aleppo Governorate. The impact resulted in substantial civilian casualties, killing 10 individuals, including eight children under the age of 15, and injuring 17 others, among whom nine were children under the age of 15. Approximately two to three hours later, a second shell was launched into the same area, suggesting a deliberate attack on a civilian-populated zone devoid of any military installations.
The targeted location was known to host displaced persons from Afrin, which had been under Turkish occupation since "Operation Olive Branch" in 2018 and was situated in close proximity to a Red Crescent facility. Among the victims, M.'s six-year-old son, Aarif Muhammad Jafar, succumbed to shrapnel injuries, while her seven-year-old son, Ahmad Jafar Mohamad, sustained severe fragmentation injuries to his hip and forearm. The attack also caused profound psychological trauma to both Ahmad and his mother. A United Nations statement confirmed that all those killed were civilians who had fled from Afrin to the area. The statement further condemned civilian casualties in other conflict zones, calling on all parties to cease indiscriminate attacks and urging states supporting the conflict to comply with international humanitarian law."
After presenting video and photographic evidence of the deliberate targeting of civilians, lawyer Ergül said that, "The available evidence strongly supports that the attack on Tel Rifat constituted a targeted strike against civilians, in violation of international humanitarian law. Turkey’s military involvement and operational control over SNA forces establish state responsibility. Given the severe human rights violations documented, legal mechanisms for accountability should be pursued at the international level."
