Speaking to ANF about the process of KCK case, defense lawyer of KCK suspects, IHD (Human Rights Association) activist lawyer Reyhan Yalçýndað remarked that they had taken the case to the European Court of Human Rights.
Remarking that a large number of people were accused of false evidences within the scope of so-called political “KCK” case, Yalçýndað said that KCK operations targeted organized Kurds who perform legal activities and express their thoughts.
“Each province and district has now a KCK case”, said lawyer and activist Yalçýndað and pointed out that the people tried within the scope of the case faced very serious unlawful implementations since the very beginning of the process.
Yalçýndað said the followings; “The process of the case has violated not only international legal agreements but also the Turkish legislations. Our numerous demands for the exclusion of unlawfully collected evidences from the file have all been rejected. The accusations against defendants consist of not only false evidences but also their private and personal phone conversations that aren’t related with the case. The preparation of accusations, the confidentiality and giving of evidences are a disaster in the proper meaning of the word.”
Stating that the KCK suspects were constituted by opponent Kurds, activists, civil society organizations, elected deputies, mayors, council members and bureaucrats, Yalçýndað added that; “This picture is as a matter of fact the summary of the state’s mentality and aims to give a message to the Kurdish people.”
Noting that even IHD’s reports on child deaths were evaluated as criminal and tried, Yalçýndað continued as follows; ”This is an intimidation to Kurdish opponents whose organization is intended to be prevented. The struggle of the Kurdish people is criminalized under the guise KCK case and reflected to Turkey and the world in this way. We decided to take the case to ECHR because of the lack of a fair trial in Turkish courts. People are taken into custody and arrested within the scope of so-called KCK operations which are now carried out almost every day.”
