Mail to British lawyers considered 'evidences' in KCK trial

The 40th hearing of the so called "KCK" (Kurdish Communities Union) main trial continued on 25 January at Diyarbakýr 6th High Criminal Court.

The trial which was attended by 64 of 104 arrested Kurdish politicians continued with the giving of evidence against IHD (Human Rights Association) Diyarbakýr Branch Chair Muharrem Erbey. While even the mail correspondence between Erbey and a lawyer from the Bar Association of England was treated as criminal evidence, defense lawyers remarked that the content of all records were about the activities of the Human Rights Association.

While Chief Judge Menderes Yýlmaz continued to read e-mail records despite the objection of lawyers, the court board turned off Erbey’s microphone when he started to make a statement in Kurdish regarding the records which were presented by the court as ‘criminal evidences’.

It was observed that the correspondence between Erbey and M.G. from the office of Kurdish Human Rights Project (KHRP), which prosecutor claimed to run activities abroad on behalf of the PKK, was regarding KHRP’s demand from IHD to lend assistance for the KHRP seminar to be conducted in Diyarbakýr about the prevention of violence against women, child rights and struggle against poverty.  

One other accusation against Erbey was to humiliate soldiers in the reports he prepared to give moral support to the people.

Speaking on behalf of Erbey who was denied permission to express himself in Kurdish, Lawyer Feride Laçin pointed out that there was nothing wrong about IHD’s performing activities on human rights, attending education seminars and trying to ensure the participation of NGOs in the meetings organized in this respect.

Speaking after Laçin, Lawyer Sabahattin Acar emphasized that the IHD activities in the region were being tried over Erbey in person. Remarking the documents presented as criminal evidences were the reports that reflected the truths, Acar demanded the exclusion of IHD activities from the accusation file.
