Urfa 5th Heavy Penal court accepted the indictment on the massacre which had claimed the lives of 33 young revolutionaries in front of the Amara Culture Center in Urfa's Suruç district on July 20, 2015.
Yakup Şahin, Deniz Büyükçelebi and İlhami Bali are listed as suspects in the indictment, but Şahin is jailed at Sincan No:1 F-type Prison because of the Ankara massacre of 10 October 2015, while Büyükçelebi and Bali are in Syria.
The suspects are accused of “attempting to abolish the constitutional order,” “founding or managing an armed terrorist organisation,” “deliberate murder,” “deliberate murder attempt,” and “possession of dangerous substances.”
Halil İbrahim Durgun and Yunus Durmaz are also listed as suspects of Suruç massacre in the indictment. However, both ISIS members were announced as dead after a police operation in Antep province.
In the indictment, “Aydın Şen” is listed as the 34th person that died in the massacre.
The indictment also includes information on ISIS and the massacres and attacks it has carried out in Turkey. In the indictment, SGDF (Federation of Socialist Youth Associations) running the “Reconstruction of Kobanê” campaign is described as the youth branch of MLKP (Marxist Leninist Communist Party) and Rojava revolution is described as “so-called.”
Families are giving statements and 70 people that were injured in the massacre are listed as plaintiffs.
According to the indictment, which includes videos from the day of the massacre, suicide bomber Şeyh Abdurrahman Alagöz enters Suruç neighborhood from Aligör neighborhood by foot around 09:01:55, wanders around the district, scouts the crime scene, and spends an hour inside an internet café.
The indictment suggests that the perpetrator was alone and “was not seen contacting anyone, getting on any vehicle, or entering any building during his time in the district of Suruç.” However, no information is given on how the bomber managed to come to the Aligör neighborhood.
Nor does the indictment provide an answer to the questions how Alagöz, who was sought by the police at the time, and police did not notice him as he wandered around the district center for two hours and walked in front of the police station with a suicide vest on him.
The indictment also involves the testimony of Yakup Şahin, who is jailed pending trial for involvement in Ankara massacre, who says:
"I asked Halil İbrahim Durgun how he organized the explosion. He said Deniz Büyükçelebi, who was operating on behalf of ISIS on the Syrian border, sent him people and materials for actions inside Turkey, that Deniz Büyükçelebi sent the Suruç suicide bomber with a vest to him, and that he sent the bomber with a motorbike to Suruç after hosting him for a night. "
According to the indictment, suicide bomber Alagöz spent time at a nearby internet café between 10:20 and 11:27 before carrying out the massacre. Alagöz reportedly read news about Suruç and Kobanê on the websites of some newspapers and news agencies such as haberturk.com, yuksekovahaber.com, and beyazgazete.com. The last news article he read was a piece on beyazgazete.com, titled “Scandal statement from Yüksekdağ'” concerning the statement the HDP Co-chair had made near the Kobanê border on July 19.
The indictment claimed that Yunus Durmaz and Halil İbrahim Durgun personally gave support and instructions to suicide bomber Şeyh Abdurrahman Alagöz and that Durmaz and Durgun received instructions from Deniz Büyükçelebi and İlhami Balı.
