Teenager arrested while already in prison

Another judiciary scandal has hit Turkey.

16 year-old Halil Karahan was remanded in custody in Mersin for allegedly “organizing and joining demonstrations” on the dates he was already in police custody.

Siirt born 16 year-old boy Halil Karahan was given an arrest warrant by the 5th Magistrates Court for alleged “membership of an illegal organization” and “staging protest on behalf of an illegal organisation” in Mersin. On the basis of the testimony by a secret witness, Karahan was accused of organizing and joining demonstrations in Kurdish populated Demirtaþ Neighborhood on 9 October 2011, the day of the anniversary of PKK leader Abdullah Öcalan’s departure from Syria in 1999, following pressures from Turkey.

Karahan provided evidence proving he was actually in custody at that time but the court nevertheless signed the scandalous decision and sentenced the boy to imprisonment.

Speaking to ANF about the arrest, Halil Karahan’s lawyer ÝHD (Human Rights Association) member Eyüp Sabri Öncel stated that the court decision had been made despite the document received from Pozantý Juvenile Prison where his client was held on the date of alleged crimes. Lawyer Öncel remarked that they would object to the unjust sentence by the court.

Öncel noted that the confidentiality decision on Karahan’s file prevented them from knowing about the evidences for the accusations against his client.

Pointing out to the lack of material evidence for Karahan’s arrest, Öncel stated that his client should be released pending trial or tried with provisions of legal control as he is under 18.

The document received from Pozantý Juvenile Prison exposed the lie of the secret witness who claimed that he had seen Halil Karahan at the demonstrations.
