Uçar expects Constitutional Court to annul Law on Execution

General Assembly of the Constitutional Court determined that the CHP application demanding the annulment of the law could go ahead.

Zülküf Uçar, President of Van Bar Association, said that the Constitutional Court (AYM) could open the way for a new regulation by annulling the discriminatory, unequal Law on Execution.

Uçar was speaking after the news that the General Assembly of the Constitutional Court had determined that the CHP application demanding the annulment of the law could go ahead.

The General Assembly of the Constitutional Court has indeed allowed the application submitted by the CHP (Republican People's Party) demanding the cancellation of article 52 of the Law No 5275 on the Execution of Criminal and Security Measures, which allows the extension of the probation perdiod from one to three years as well as of the whole law.

The AYM General Assembly made the first review of the application on Wednesday and did not detect any deficiency in the application. The annulment request therefore will be discussed on a day to be determined at a later stage, and will decide on it. 

Speaking to ANF, the President of the Van Bar Association Zülküf Uçar said that their expectation was the cancellation of the law, which "goes against the principles of equality and the rule of law as well as the prohibition of discrimination."

Uçar added: "Unfortunately intellectuals, lawyers, politicians, journalists, academics are still in prisons due to the situation created by the Anti-Terror Law. The Constitutional Court with the libertarian and legal decisions it made in the last months could open the way for new regulations."
