European Court of Human Rights (ECHR) has rejected the application of the imprisoned Kurdish leader Abdullah Öcalan for retrial, on 6 July.
According to the Turkish news channel NTV, Öcalan applied the Strasbourg Court in 2007 after Turkey has failed to re-try him in accordance with the judgment of the ECtHR in which the Courth had decided that Turkey violated the Article 6 of the Convention protecting the right to fair trial during the Imrali trial in 1999.
In his application Öcalan had claimed that he was not re-tried according to the judgment by the ECtHR, that Istanbul Heavy Criminal Court has failed to hold a hearing while implementing the Court judgement in the national plan and failed to review the merits of the case.
In the judgement the Court stated that the right to re-trial is not a right protected within the scope of the right to fair trial enshrined in the Convention and therefore, the application was rejected without reviewing the merits of the case. It is also reiterated that the Court is not in charge of observing the implementation of the judgements and the case was closed in 2007 after it was presented to the Committee of Minister is responsible for the supervision of the execution of the judgments of the European Court of Human Rights.
Ömer Güneþ, legal representative of the Kurdish Leader said to ANF that they have not received the judgement yet. He also stated that after once they receive it they resort legal remedies open to them.
